Lawspeaker and Claim

If I'm a lawspeaker and a villager have a claim in the village I can revoke it,but in order to do this I must stand next to the stake claim.Will I have scent for trepassing the claim?
Also if I'm lawspeaker of a village and I switch to another village,will the first village survive without lawspeaker?

As for your first question I am pretty sure you will leave a scent, but trespass doesnt mean anything anyway.
If you leave the village the others should be grand but anyone who can get to the village claim can then become the lawspeaker.
I may be wrong but I am pretty sure I am right.

Only if the claim owner did not grant you trespass permission and you had to turn opn criminal act.

Yes. Who is able to take the lawspeaking position is determined by how much authority it has left (assuming they have the Lawspeaking skill). If it is above 50k, then only a villager of that village can be able the position; if it is under 50k then anyone is able to.
