Dead Personal Claim

One of my villagers has just died and he had a personal claim...now his char is logged out and there's a claim of same size and same position we can't pass.Has someone copied it or is it still our villager's claim?Is it possible to destroy it(without a village claim please)?

This claim still belongs to your old villager, however him being dead means that you are all now off of his kind list, hence not having any permission. Only a few ways to remove it - ask him to respawn and move it himself, or erect a village statue and revoke via lawspeaking.
