I have a murder scent but I want to know can summoned people fight back?

while we're on this topic i have a question. is there some rule against summoning kin.
because back in W4 my friend left a vandalism scent in our village and i tracked it to his h.f, i tried to summon him<NOTE: i was not going to kill him i just wanted to see how summoning was done>. but i right clicked on his h.f and the scent and basically anything that i felt should be right clicked but i couldnt get it to work.
why??

You can summon and kill kin. Are you sure you were tracking it to the right hearthfire?

yes i ran circles around his h.f and no matter which direction i was it always pointed to the h.f
could the fact that he was lawspeaker have anything to do with it
