Get a village Lawspeaker or someone to invite you in.

if your lookin to join a village, you can also goto the general forums(the inn of Brodgar) and state your looking to join a village, but be advised you better be able to swimm across rivers(and in that aspect have your CON 45+) cause most villages are over a river or two.

No. The lawspeaker comes to the RoB and swears you there. Then, if you have the agility, you "travel" to your village idol. You do need (some) agility, but probably not anywhere near 40.

Also, I'm not sure about the across a river thing. I think the direct route to most villages is across a river, but it's amazing how far a non-swimmer can walk - if they can handle level X boars, foxes, etc.
