If you read what loftar said about the consequences: They wanted to see how it was influencing player behaviour and whether it was a good change or not.
Basically saying just because it wasn't intended that way doesn't mean it wouldn't be kept if the influences were beneficial to net gameplay. Scents like tresspassing have never had any real consequences for leaving them. And even murder was meaningless to anyone with a good vault.
I like casual raiding having a cost associated. Noobs being raided = less established nublet villages to raid later = less endgame player retention and social content.
