You only need trespassing to access the claim, if the claim is truely abandoned it will allow you to destroy the stick without leaving any other scents.

No, it won't, your char will just stand there doing nothing. I know a few 'abandoned' claims though where nothing is going on but the owners must log in once a month just to keep them active, for whatever reason, so it's not always as it seems.
