I found reek of theft on my claim and I'm planning on tracking down the thief and summoning him. will that instantly kill him? I've heard forced summoning kills the summonned on but i don't know if it applies here. thank you

it will instantly kill if player do not have hearthfire (i.e. you summon by clicking on ground anywhere in the world), in other case you have to find thief's HF, summon him on it and kill him by yourself (as far as I understand murder scent will be left).

If his scent is in a house in a wall you wont be able to summon unless you get in the wall. If you break the hf and summon they die instantly. I think summoning them leaves a rage scent, and knocking them out and killing them do leave scents. So if hes right next to a river and u summon him and you live in a palisade or something, you are just as likely to get killed as him (other people will come after you)
