How do I do criminal acts?

So my guy is out in the world starving and I come across a base I am going to die so I want to attack just because I guess. So I turn on criminal acts to use destroy and attack the gate but it tell's me "This land is owned by someone" and it won't let me destroy. I thought you could attack and greif but I cant so I think I'm doing something wrong. Any help?
