1. How do you know when somebody has a stake claim. Is it that white pavement?
2. What happens when somebody finds out you stole from them?

1. You get a message that the land is owned when you try to enter it. And it's a pole with a skull on it.
2. You get summoned while offline and killed. People often won't bother doing it if you stole only a couple of low-q items, though, unless you're a repeat offender.

1. Turn on the option to see claims by clicking on that little skull above your minimap. Claims will be outlined pink from now on.

2. He first has to see the scents you left (footprints on the ground while tracking is turned on). He can then find your location or the location of your hearthfire by using those scents. Once he has found your hearthfire he can summon you there with yet another scent and kill you even while offline.

Basically yes, but applying a little more imagination, you leave signs of passage... a paddle print in the mud, broken reeds, a trail through the lillies, whatever you want.
