Newbie question about death

Alrighty, so I learned 1st hand that when you die your character is gone , but my question is, if I on my new character, go up to my old characters body(which isn't on any claimed land), right click it and select 'steal' to pick up my old items, does that leave a theft scent even if I don't have the theft skill and criminal acts is off?

No it won't leave a scent. It used to, but I am pretty sure loftar fixed it so you can take the stuff from your own ancestor without leaving scents.

How does he get killed from leaving a scent? can animals track that? i know that a player wouldn't track and kill him for no reason

Yes, a player would track and kill him for LP and lulz. Never leave scents if your hearth isn't secure.

Sorry did not see how long you were around, no offense. But you seem to have a very optimistic opinion about human nature. There are plenty of players out there who just wait for the opportunity to see some scent lying around and kill for the lulz, like Potjeh said.
