You make no sense. There is no more of a written law in the real world than there is in haven and hearth. The only reason law exists is because the government enforces it upon its people. Crfernald was playing the role of the government in this situation, and there is absolutely no difference. A force more powerful than you is telling you to obey or pay. You didn't obey, so you paid the blood price. It's the exact same in the real world buddy. How do you know he doesn't have it written on a piece of parchment somewhere? It's not like you see the parchment on which the united states government writes their laws.

Except said government here only has dominion over a small area and is nowhere nearly as powerful as a full blown country, plus I doubt crf wants to deal with a bunch of paperworks and delegations that actual government has to deal with as well.

You miss the point. Whether it is a formal, elected representative republic or a band of vigilantes, it is practically the same.

Okay.
Walk from one side of the world to another.
Now walk from one side of any country to another.
H&H is much smaller, right?
And they control only the north AFAIK.
And paperworks, what does that have to do with anything...?
Nini's point was, the current government IRL works, some people with power and influence decided to do what's best for moral behavior.
In H&H, the government is a bunch of retards, but they have power and influence, who says they can't set rules?
Take MM tribe for an example.
They practically control the Boston server in Salem.

Except it didn't look as orderly as you might think. We were talking to a villager standing by the shore (and we weren't on any claim), then a bunch of people on boats appear and start surrounding us, asking "do you have flots" somewhere during the process. And something about "troll toll" was said when my mate was already being killed and I was aggroed. In short, it was a fucking mess, and the roles of anybody weren't clear in this situation, if anything, it looked like an ambush.
