No he shouldn't. The option to kill somebody for free just because you died is laughable in its own right. What other game does this? I've played a plethora of PvP games, and not one has gave the guy you killed a free kill on you just because you killed him. There's a little thing called tough shit in that regard, be more careful next time.
Killing people should have the PKer be punished, but not by death from some magical ghost, that's just dumb.
In UO, if you kill people enough, you turn red. While red you are banished from the main towns and other players are free to kill you, consequence-free.
In Lineage 2, if you kill somebody, you again, turn red. While red people are once again free to kill you without they themselves turning red. Also, simply being red gives you a chance to drop items too.
Many games go this route, it's effective and it works. For this game, why not make some similar negatives for people killing? Have nidbanes serve another purpose, like causing a Flay wound if you lose to it which would be nasty as fuck. Also make it so that people who kill a murderer can do so without worrying about dropping assault, battery and murder scents.
There's a plethora of other options, you don't get to freely kill a guy who killed you just because you're upset he killed you, that is fucking plain retarded.
