I think this will be fine if private prison company is judged on proper metric. If something like rate of redo criminal after sentence ended is what it is discriminated. So that prison with lowest repeat offending rates getting contract. Then maybe these company are competing to do what is desired outcome best. Instead of just lowest cost to lock people in cage. I do not think very hard on this, so maybe I do miss some thing. At least I think this idea is not just blatant bad.

This is very clear conflict of interest for it, yes. I suppose there is no good way to be preventing prison company to influence this law either because of lobby and corruption and thing like this.
