It's not a copyright violation if they write it from scratch.
Copyright doesn't protect ideas, patents do. I doubt Jorb/Loftar have a patent for player controlled boats in MMORPGs.
Anyone could go off and make a store-brand version of HnH.
At least as far as intellectual property is concerned. Them trying to compete in this unbelievably small niche that's already occupied is another thing entirely.
