I haven't played since the new mine pyre mechanic was introduced. I took over a claim that has a mine hole on level 2. It appears they made a mine pyre on level 2 but never built the minehole. When I try to build the minehole on the finished pyre it says its too hard below. Is this because the ground hardened again and I have to build another pyre or is it because my STR is so low that even with a pyre I'm not strong enough?

Should be the latter. You can probably test/verify by trying to place a minehole somewhere else and comparing the error message.

if there is no lawspeaker, any character should be capable of claiming the lawspeaker role

try to rightclick the village idol thing (whatever its called) and see if "Become lawspeaker" is an option

Yes, but the Character does need Lawspeaking skill?

To be clear: it's primarily intended that any other Villager can become the Lawspeaker. If there are zero villagers (or the Village has an out of Authority) anybody should be able to seize the Lawspeaker position.
