Or if the gates are open, just turn criminal acts on and trespass? Trespass scent is nothing.

You might notice from the pictures: they are not - that is the problem.

Looks like a superior force has captured and monopolised a local resource. This happens all the time. Here are your options:

1. Diplomacy, work out a deal with the owners
2. Use force, take the resource for yourself or the public, maybe kill the owners.
3. Flee the area for more forgiving lands.

You can criticize the mechanic, but it's not all that different from localized resources or high q resource nodes. You can criticize those mechanics too.
