No, those are spent forever. The only difference (I think) is that it costs 4k LP more to build a claim if you already have at least one.

how does the new claim system works. anybody can step on my claim and do whatever without leaving scents for first 8 hours? does staying logged in/out matters?

i finished my claim deep into the night, went to bed and woke up with everything raided and destoryed, not sure if i was just unlucky or it was my fault.

Indeed it takes 8 hours. Moreover, after those 8 hours you need to walk up to the pole and right-click it to activate it; it will not automatically activate.
