I wouldn't necessary try it, but I understood that if the subscription/store item is destroyed or deleted (dropping into ground and map unloading, dropping into water) then it can be reacquired from hearthfire. They supposedly are destroyed in a puff of smoke if another hearthling tries to take subscription/store item that doesn't belong to them.

Two possibilities exist:

1) You claimed an item before Sept 1st's update. These are permanent in the world and can be looted or destroyed. Care with these items.

2) Items after this are locked to the account. They can't be looted, and if destroyed, can be obtained from your HF again. (As of this post, I believe there's a bug that allows you to claim from any HF. May have been fixed and pushed to live already.)

Any instances of hats already withdrawn from a Hearth Fire before this update, will also remain as legacy items as they are, irrespective of where and how they are, with their old functionality of being a normal item completely intact. Consider these now epic l3wt legendaries a bonus for the early bird punter who hasn't yet managed to lose his hat.

If number two, just throw it in the water or w/e. Arguably you should be able to right-click it back into your HF. Making note of that.
