Cant actually be sure but i dont think so. Killing is a criminal act so i would guess that if someones kills another player outside a claim, a scent is left neverthless (:

However trasspassing and vandalism scents only appear in claims.

P.S: not sure, lets see if someones confirms or teachs us both :P

Good answer. Claims aren't the only place that property scents can be left. There has to be some forn of ownership, though, such as an occupied lean-to.

Crimes vs a character can be left anywhere.

Scents are result of an crime. Assault (aggroing another player or "Hearthling") Battery (KOing Hearthling) and Murder (permanently killing a Hearthling) always leave scent* regardless if there is or isn't a claim. Tresspassing, Theft and Vandalism require claim by definition, but can be left without one by following actions:

Tresspassing: Using "steal" option to look at KO'd or dead Hearthlings equipment screen, inventory and study.
Theft: Actually taking item from aforementioned KO'd or dead Hearthling. Taking items from owned leanto (leanto will offer limited protection for liftables placed on it for everybody but the player who put them there)
Vandalism: Destroying owned leanto. Destroying hearthfire that is not yours and not on your personal claim. (You need to be the claim owner, not just have vandalism rights on it.)

*Scents can be quite hard to detect if they're left by player with high INT*Stealth. Like with foraging, your ability to see scents is determined by your PER*Exploration. (Weighted against perpetrator's INT*Stealth.)

Or destroying a waystone that belongs to a claim-protected road.
