1st one is just a game statistic (see my response to ARX) so it is a probability of winning inf PVP. It is not a hardcoded rule it is a rule which should be achieved by tuning combat mechanics. This cannot be abused by definition

2nd one is a loss during death. While this can be abused (having 50 stat char not progressing any further) I was not able to percieve any game-breaking ways. Pros of it as of newbie and casual protection outweight such cons to me.

They don't want it. And I agree with it (mostly due to population concerns and absence of victims to carniveore players)
Noob has to be pushed away from casual island at some point. Otherwise it's the same as PVE server

It's not the noob I'm thinking about, but more of a casual guy.
He is involved in all aspects of the game (hunting, mining, trade, raid or be raided, quality nodes taking), he is just unable to keep up the progress speed on the same level as hardcore gamers. And after being raided he is unable to recover as fast as hardcore gamers. So it is fair to me that he is punished a bit less.
