There are plenty of reasons to make a claim extend in to water;
boat parking, docks, lobster traps, manual fishing areas, clay spots
What exactly makes fishing nets deserve their own special attention?
It's suppose to be a passive way to get fish when an entire manual fishing mechanic already exists, I think having to rely on regular claims or gamble on not claiming at all is a pretty fair trade off for not spending hours manually fishing tbh.
Good idea let's copy this on all of those

Seriously, ditto this idea for lobster traps.
Docks take siege to destroy, why do they get special attention? They're more important and cost more, but nets need far less protection than a dock gets, and rightfully so.
Also the fishing mechanic sucks, you shouldn't have to spend hours to manually fish. The trade off is not being able to go for a specific fish. I don't know any non-casuals that fish late world. There's an economic concept at play here, I can't remember its name. Essentially manual fishing is so goddamn awful we've unfairly put more value on net fishing.
Ultimately though this would be a minor change. A matter of annoying claims on shores vs ability to raid unclaimed nets. Maybe compromise by making it so you could "check" a net without pulling up, getting the fish and leaving a tresspass scent if its not yours, or actually pulling up the net, which would be theft?
Boofing and gumping it all damn day. Shoutout to my homeboy Moloch
