I'd argue that's
mostly a problem with the boats not requiring explicit trespassing when crossing a claim, like walking does. But yes, there seems to be some bug involved as well; as long as you were the last to row the boat, it should always be possible to get back on. I haven't managed to reproduce the bug yet, however.

While that is, indeed, one of the funny situations that the current system gives rise to, I would argue that it isn't exactly game-breaking. And that it isn't
entirely unreasonable either, actually -- you were close to their territory, so they used their dominance in the area to claim the stuff you didn't close enough watch on. It can be argued both ways. Either way, I cannot bring myself to see it as such a large problem that it warrants replacing the entire system with something bound to become orders of magnitude more complex.
EDIT: There are greater flaws in the system as it is. I'd consider one of the greatest to be the aspect that gives rise to such situations as being unable to pick up something you dropped from your inventory while in someone's village, especially seeing how one isn't warned when walking into a village. Such things should and most likely will be altered in one way or another. I'm just not sure exactly how yet.
