I'm sorry I didn't know this was a deathmatch arena type game. Any attempt at player driven content obviously is above the average gamers head these days.

You could actually ransom for valuable characters, or have another, more temporary way of removing people from their chars.

Actually I don't really know why this idea constantly gets shot down, you cal allready remove someone from their character permanently. Now, you could imprison somebody and force them to give you something (loots, locations, names, cooerpation). and give them back their character. You should ofcourse also be able to be broken out of prison by your buddies, or suicide as captive.

Since noone would actually play while imprisoned that is.

your an idiot.

also, this is a sucky idea because there is NO PETTY CRIME! just CRIME. You Steal, you Vandalize, you Assault, you Murder, and you DIE!!! Tresspassing is the only thing that isn't an actual crime, and those scents are back-ups for the real crime.
Crime is Crime, and the punishment is Death. Simple, yet effective. Who would have guess it?

There is no Petty crime? You list several there. Though the punishment for almost all of them is death? I think this is because you get a free pass to loot the criminal afterward.

In soviet russia, death kills you.

Punishments less then Death need to exist that is true, but any kind of 'time-out' is going to be exceedingly hard to do because of the nature of the game, at the very least people have alts that circumvent this at the most basic level.

A possible alternative that I think could work is 'branding', a ranger with a scent, matching hearth-fire a branding iron and coal could perform a branding action which permanently (or at the least a very long duration like 30 days) marks the character with a brand related to their crime. Other players can see the brand/s easily (displayed over the characters head) and shun them as or not as they wish.

That is also a good idea. The Prison wouldn't be a cell. It would be more like a work camp. You work off your debt to society, and can work toward paying restitution to you victim. That or you can be murdered. The only problem would be making the scent for the crime go away. Your branding idea would work.

How do I get home?

Let's see... I read a parchment on some inactive person's land claim using only trespassing; I have left a theft scent. A ranger passes by and fills his inventory with the scents. He tracks me down, loots my home, destroys anything that can be easily destroyed, summons me, knocks me out, then drags me back to his prison. When I log on, I'm confused and forced to help him get ahead at no benefit to myself. I decide this is shit and try to make a break for it, but I don't have the theft skill, so I can't even search for a key to get out. I run around naked with only half a dozen peeled potatoes and a q3 stone axe in my inventory, he catches up to me with his waterflask and knocks me out, then throws me back in my cell because he can. I bitch on the forum and jorb/loftar probably end up releasing me if they can be bothered.

There's one solid rule about Haven & Hearth: you cannot trust anybody you don't know. People get antsy if you simply face them because they think you might be aiming at them. I sure as hell wouldn't trust some random ranger to keep his promise to let me out after he's done ruining my gameplay for a day or two.

I would like to see lesser punishments rather than murder by morons who don't even know what you did, but I don't think prison will help any in this game. There's no greater authority to ensure the guards aren't being huge douchewads; there are no universal "human rights" or "laws". I think breaking someone's arm/leg (obvious effects) might be more suitable as a warning, and perhaps it could get infected and/or not recover if not treated properly within a few days. Branding, shaving someone's head bald, and gluing feathers onto someone's body might be more fun as lesser punishments.
