Scents are the most fair and equal aspect of the game. Arguably the second best system, only behind the food system. You can make the case that other systems are done poorly and detriment it, such as the siege mechanics, but that isn't to say scents are poor.
Scents have no bias and no loopholes for abuse, if you commit a criminal act you leave one. Only serious criminal acts such as Murder, Battery, Vandalism, and Theft can be used to summon and kill you. Otherwise minor criminal scents can only be, as you suggested, used to track you down and find your location.
There are in-game skills and structures which are necessary to hide, track, and be tracked. You can cover your criminal actions up, sniff out clever criminals, and defend yourself by defending your hearthfire, the location that rangers track scents to. If you're unfamiliar with the game and just leave your hearthfire out in the middle of the woods, then you'll die very easily. If you're smart and have even basic infrastructure such as a house and some walls, it can become an arduous task to achieve justice and kill you.
For what you're suggesting I could walk over to my neighbors house, push it over, take everything of value he has, and murder his buddy, then go offline. When he logs on he discovers that I've commit crimes and comes over to my house to wait for revenge. 17 hours later after I've woken up and gotten home from work I finally log back on. He has been standing there vigilantly for the entire time waiting for me. He has spent his time well and both parties had tremendous amounts of fun.
No.
