His arguments are absolutely valid and good thing the charter didn't have a wall around it so mentioning that patch has no relevance. Yes, technically the gate mechanics were bypassed but not as a direct result of performing an action which they shouldn't have been able to do but rather using the way the mechanics currently worked to their advantage. Questionable behaviour? Sure but not exactly on par with jumping the wall with a chair or the like.
