There was a thread about it a while ago where an idea about this was discussed where you could somehow tie up a criminal hearthling for some amount of time based on what scents were left. That would be a better system in my opinion then permanently crippling a character. Just make the time spent tied up only come down while the character is online or some other way where people can't avoid the punishment.
