Some kind of system that would punish criminals instead of kill them has been thought of many times. I don't think a theft scent should be able to permanently hurt a character. But, trapping characters, now that is an idea. There was a thread about it a while ago where an idea about this was discussed where you could somehow tie up a criminal hearthling for some amount of time based on what scents were left. That would be a better system in my opinion then permanently crippling a character. Just make the time spent tied up only come down while the character is online or some other way where people can't avoid the punishment.

This would replace the current massive reliance on Skype, a service that's pretty shitty completely unrelated to the game.

Eh, theres something nice about after I sprint at some kid and kill him, that he cant call his "village friends" while I sift through his junk. I appreciate that when hes dead he cant message anyone. Obviously for villages that all use skype and stuff it doesnt matter much, though. The other downside is that you would be partially logged in to the server if you can chat. = more lag and stuff

what a shame it looks really nice but it just had to be released when the other good games are releasing around march, so i'll likely not be in it

No a containment system is not ideal. It is a game and to hold or imprison a player by another player only makes things much worse. Let alone you would have to add an entire theft and evasion system to cover lockpicking, knot unraveling, climbing... I think thats a lot to ask right now.
