I believe the legal definition of murder is being argued here. What he did not commit was 1st degree murder as that is premeditated murder. What overtyped is describing is 2nd degree murder where assault occurs and death accidentally happens, such as in the case of the 14 year old. This case is manslaughter as it lacks premeditation, intent, or malice. It was a road side collision that ended tragically. Such tragedy still warrants some kind of punishment but, failing to see the irony, the judge gave the rich kid a leave of punishment because he has never been punished before. Some states may upgrade manslaughter to higher forms of murder if you're driving intoxicated but I have no idea if this is the case here.

The ruling was terrible and this judge is known for making terrible rulings. Jean Boyd isn't a good judge by any standards.

This doesn't mean the kid or their family will get off scott-free though. Much like the OJ case, even after essentially winning in criminal courts, they still have to face civil court suits and will probably be looking to lose most of their fortune to the families that lost loved ones and have incurred injuries. This doesn't make it suck any less mind you and I think everyone in the world is angry as can be at this ruling.

Nah, it's because murder is okay in the US as long as you are rich. This is just the most recent case of that, and who knows how many cases like this don't reach the news. I guess the USA really is the land of the free, because they love giving freedom to killers.

A girl I dated hit another car head on. The other car held 2 passengers. A mother and young child. the mother was alright, but the child had spinal injurys. My girlfriend at the time was high on Xanax and almost died herself. She was 16 at the time. We were both in highschool. My gf was charged with first degree assault, but ended up with 10 years probation. We broke up shortly after all this and a couple years into the probation she broke it. They sent her to a 6 month rehab. Followed by a half-way house for women. She got out and it wasn't long after she broke it again. This time she went to prison. She wound up serving her time after all.
Just before the above happened my father left for work and was hit head on by a drunk driver. It killed my father, but the other guy walked away with a bloody nose. The drunk had numerous empty beer cans and a half smoked joint in his car and he tried to leave the scene. Being 16 at the time I do not remember what charges the guy faced. I do know that he never served a day for it. Tbh I can't even remember his name now. Maybe he is dead now, or changed and brought joy to someone. I'll never know.
Justice is hard to really come by. Things are not cut and dry now and you can never get back what was lost. This kid got a break. I feel very sorry for the families. I do not know the mindset of the kid, but I bet he wishes everyday that he could bring the 4 victims back.
