This guy is a thief. He was the only guy who has access to my land and a chest and sword are missing. Just thought I would let you know everyone. If I don't get my sword back...

So if I steal a ball of yarn and someone else steals a bar of gold, we should both be punished equally?

Until a society is full developed, yes. At least if it's done to me, independent settlements have their own laws. When people set down a claim they reserve the right to punish thieves as they wish. They just open themselves up to retaliation.
