Not all games should, there are plenty of games that dont... this one does.. and this is one of its many charms. If you are not happy with the game mechanics and mind set then the internet has many other games that may suit you. Im not sure why people keep thinking that the people who enjoy this game would support calls to change it on such an intrinsic level.
Can anybody fly this thing?

This is where the fundamental flaw in your argumentation is.

the game is not all about the violence, hate and harshness of real world. but its more about human nature and society.
you can always choose to go Mahatma Gandhi and never use violence, or go Genghis Khan and rule the world by war.
the difference is, this world is not as sophisticated as real world, and you can reincarnate right after your death with all your memory, your claim and friends, and some of your LPs back as well. (its a game after all.)
it may take you a while to get used to this concept, but once you start seeing it, youll find it interesting too.
is going "peaceful" actually possible without having no force and no power? what is the price for your goal?
how can media (for this game, the forum) influence people's mind?

regarding the "About" article, i believe the devs did talk about their policy on this free PVP even if you didnt see it.
every player who spawns will interact and affect your game life in many ways. its the players' choice that makes this game going, not the scripted NPCs nor devs' prejudiced systems on what should be justice.

you settle at one place, but your existence there affects your neigbors directly, and others indirectly. because your obtaining some resources means less or lower quality resources for others. your neighbors who used to get those at higher quality may not like the fact that they arent getting what they used to get. also, your neigbor may start cutting down trees and change your environment. you also change your own and your neighbors' environment by settling down, buildng your housing and working your way out to develop your charactor. and then you decide how to solve this. some choose to fight, some choose to talk, some just give up and move away.

once you understand how your own play affects other players and vice versa, youll find yourself making friends too :)

And surprisingly, there aren't many games on the net where you can freely build and change the world - Wurm, Tale in the Desert, Minecraft.
None of them have as fun economic system as HnH and none is as interactive. But in HnH other player can come and ruin everything. Bah, you can't have everything.

It's hard to believe that sometimes. You know, for the last month I have seen only one new (as in low level) player. Few corpses of new players. One helpful player. 2 people who kept stealing from me. 4 that tried to murder me. It seems like new players have no right to play and they are decimated by bored high levels.

Stories without villains are boring.

Why not just a system that, like OP's, doesn't let the dead character be used for a certain period of time ("recovery period"?), but instead of being fixed it could be determined by said character's total LP? For example, Sqrt (Total LP / 10) = Recovery time in hours (affected by the tradition/change slider) -- or something like that.
The recovery period would have to be extensive (time-wise), perhaps extensive enough for the character's owner to be able to develop another character with the same amount of LP as the old one,.
At the end of the recovery period you could have the option to recover said character, or maybe let it die and perhaps sacrifice its corpse to the gods.

After all, when you die, all you really lose is time.

Wurm is shit.
Minecraft is a whole nother genre pretty much.
Tale in the Desert - Never played looked like crap.

HnH is good but one of the best things that make it good is how open it is, even in PvP and killing. Perhaps not as much should be given back after dying. (and kin list should totally be kept to next character man ; and totally redone).

The flaw is that you won't be able to catch up or kill them. You will be able to eventually, just don't expect to be able to do it ALONE. You need experience in the game to learn what it is you need to do beat them.

what DoG said above, but if i may add my personal opinion,
1) you never know if the guy would be more infuriated than you are/were. he could be just one of his alts.
2) most everyone is stronger than a newly spawned, and he can NOT kill anyone he wants. -only Jorb can.
the real high leveled players dont bother killing new players UNLESS you are settling down on some high quality resources or you annoy them badly for some reasons.
None of them have as fun economic system as HnH and none is as interactive.

the current system makes H&H have this economic system and interactivity, whether you believe or not.

you dont wanna believe what you dont believe. that is all.
you cannot become Gandhi nor Khan when you were newly born/spawned, all alone, no friends around.
peace and freedom are not given out free depending upon where and when you were born(spawned, on this game).

ever read about Malcom X? its pretty interesting how his views changed as he faced different events through out his life.

Never got killed in pvp. Playing since w3.
Its just about how careful you are at the start.

You know there are murdurers sailing around => manage to not get spotted. Settle at a distance from rivers(this will help u in future also^^). Set 'travel to hf' on a hotkey. get ender or arksu client. move around when talking to strangers, try to talk from a boat or from behind the palisade. not too hard, right? That already will reduce your probability to get killed by a "bored guy" by ~80%!!

And that brings much thrill, when having one chasing you around the river system, that you know, an he does not.

You may hunt those "bored guys" later, when you get bored. Just take on a spruce hat, and wait for one. And when it comes to cqb occasionaly chop him with a q70 stone axe with ~200 str, when they drop his def charging you. Now THAT is really a fun. Those travelling nubhunting murds are often not really strong, having murdur learned and less then 100 UA. Just make sure your frends are covering u if something goes wrong.^^
