I'd just be happy with walls that can't be broken down with bear hands / single person with a tool in < 1 RL day and making it so people can't shoot arrows at you through a wall.
"air is free" douche baggery theoretically only happens off claim, so once you've set yourself up / joined a village it's not a problem.
The exploits that involve surrounding someone and shooting them with arrows a -> requires more coordination than I believe possible and b -> does not impact people who don't want to play pvp.
Trades can be conducted on claimed ground using party / access privileges.
Basically I think it would be a problem for new players and those not in villages and that's about it, particularly if village management was expanded so that bozo's could be evicted from village grounds and banned.
Having said all that, I am not at all in favor of it. It would be quite a different game, I just wanted to point out that while making the switch to non universal PvP would definitely come with its own set of issues, said issues are largely solvable and it is not at all impossible as the PvP advocates seem to be suggesting.
I think for the most part it's J&L wanting to simulate real world interactions where you do indeed get assholes every now and again, and the solution is to either ignore them, walk away, or punch the buggers in the face.
