Brick pavement not counting as Pavement ?

Ok so I just walked passed my friend's plot and noticed his Brick-gate is red. Its under Village claim / His pclaim. And it was build after the decay patch.

I was wondering why it decayed and I realised it was build on a Brick pavement (Red). So does building stuff on brick pavement not count as that of stone pavement or is this intended by Jorb/Loftar.
