That was a straight up emulator. I'm not sure on this since it's a major modification of WoW using the client assets. I believe it is a violation of TOS/EULA and they could ban anyone they caught running a client on it if they so desired.

Do you have to pay to get a beta key?

That's what it looked like to me. It looks interesting and I might want to play on it, but not sure I want to put too much money into something like this, either. Could be the pay thing that gets it shut down in short order, too. It's one thing to do fan stuff for free, another to be potentially taking money from the IP owner.

Yeah even if they changed the gameplay significantly it's blizzards art and the abilities are the same so charging a fee is definitely sketchy at best

Blizzard has copyrights on every asset from WoW, as well as the right to make any derivative works of the game itself.

We are far outside the realm of fair use. It doesn't matter how modified it is, nor does it matter it they charge, it's still a copyright violation. The only question is whether or not Blizzard intends to pursue legal action. Generally, most emulators have not been shut down by threat of suit, but some have when they became popular enough to attract a publisher's ire.

If I've understood correctly, Nostalrius only received threat of legal action* and they decided to cave in on that alone. Some people have blamed the Nostalrius devs did that on hoping Blizzard would hire them** to develop and maintain an official vanilla realm. The fact that official legacy servers didn't happen and Nostalrius is supposedly coming back doesn't contradict this.

*Blizzard has much harder time shutting down servers not hosted in USA. It's possible but I guess it requires long and likely expensive lawsuit with potential PR disaster.
