As far as the game rules / Hearthlaw is considered, no crime against the CLAIM has been committed. It was a crime to loot a body, but the crime was committed against the person being looted, not the claim.
Similar thing previously allowed people to bash other people's Hearth Fires while under Visitor status, because game only checked they were only committing crime against the Hearth Fire itself, as they have innate crime protection against anyone (excluding the owner) even when unclaimed.
Also, if you made the mistake of parking your character near visitor gate in a suitable angle, you could be aggro'd through the gate and beaten to death. This was only fixed indirectly when Visitor Gates were changed to be impassable while in combat.
So, chances are, tents and leantos could also be affected by this?
I wouldn't be surprised.
