Lifting an object off a village/personal claim falls under the rummaging restrictions.

Lifting something out of a cart, wagon, boat, etc still falls under theft.

EDIT: When lifting from a cart on someone else's claim, the object lifted is flagged as not being stolen, and you are only allowed to take them by virtue of being the last driver of the cart. So if it weren't a case of theft to take things from a wagon, you could simply steal from any wagon without it being theft when they are moved off claim.
