It's kind've odd when the 'justice' is considered injustice. These 'Possession' rights should only apply to this, as the other causes too much conflict >.>

There's no concept of ownership in the game though, only land rights. The game doesn't know that it was YOUR soldier sword that was stolen, only that the soldier sword WAS stolen. You can track the stolen item, but so can anyone else with that theft scent. The way you're describing allows someone ELSE to track down the thief and steal YOUR soldier sword without leaving any scents, leaving you without an item.
Basically you're trying to overcomplicate the system.
