Mythic was successful in defending a trademark for "Realm vs Realm" preventing anyone else from using it. It hasn't stopped anyone from developing a faction vs faction vs faction setup, just from using the trademarked phrase. (Seems like that was in the suit, but fuzzy memory and the years probably have me in the wrong here.)
As far as code, iD Software had always published source code for their games a few years after publishing. The Doom 3 code was held up because of a patent issue.
